Kidnapper Will Now Be Charged – CoCo District Attorney Caves Under Pressure

This case is making more turns than a High School Marching Band. A 4 year old boy was taken from the front of his home by a transient who was admittedly drunk and just wanted some company eating dinner. The young boy was found a short time later, alone in a nearby shopping center by relatives. The drunk homeless man flagged down Concord Police and told them he had taken the child. The police did the right thing by arresting this drunkard and then the case went to the Contra Costa County District Attorneys office. This is where the story goes sideways.

The Contra Costa County Assistant DA who got the case threw it out. Claiming no crime was actually committed. I guess DA Kochly wasn’t expecting the people of Concord to question his authority. He was wrong. As I understand the law, I logically understand why it would be hard to charge the man with kidnapping, but to throw out the case entirely was ridiculous. Hasn’t DA Kochly already been slammed enough in the media for being soft on crime? The Contra Costa DA’s office hasn’t had a great 12 months. Late last year one of the special prosecutors was brought up on allegations of rape.
Today the Contra Costa District Attorneys office made another turn and stated that they would in fact seek to charge this man with ’something’. I am interested to find out what charge they plan on sticking to him. With this fiasco, I also wonder if the court appointed defense will be able to poke holes through this entire mess of a case.
